Terms & Conditions
1. Scope of Services – True Datum Aerial will supply only the services described in the contract. Any additional work requires a written variation.
2. Data Accuracy & Reliance – Deliverables are for progress monitoring and general information only. The Client must obtain independent verification for design, set‑out or legal purposes.
3. Liability Cap – The total aggregate liability of True Datum Aerial, whether in contract, tort (including negligence) or otherwise, is limited to the lesser of (a) AUD 87,500 or (b) the professional‑indemnity insurance cover available at the time of the claim.
4. Indemnity – The Client indemnifies True Datum Aerial against third‑party claims arising from the Client’s onward distribution or misuse of the deliverables.
5. Insurance – Public Liability AUD 15 million and Professional Indemnity AUD 87,500 are maintained. Certificate of Currency available on request.
6. Payment & Ownership – Title and intellectual property remain with True Datum Aerial until full payment is received.
7. Cancellation – Flights cancelled by the Client within 24 hours of mobilisation incur a 25% fee plus unrecoverable costs.
8. Force Majeure – Neither party is liable for delays caused by events beyond reasonable control (weather, airspace closures, pandemics).
9. Governing Law – any agreement is governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of Victorian courts.
Accuracy Disclaimer: All accuracy figures stated are based on manufacturer specifications for DJI Matrice 4E RTK systems using CORS corrections and are achieved under optimal GNSS reception conditions. Vertical accuracy without GCPs is typically ±3–5 cm relative to the RTK coordinate solution. Deliverables are suitable for general engineering, monitoring, and volume reporting, but may not meet survey-grade standards without independently measured ground control points. It is the client’s responsibility to confirm whether GCP-verified accuracy is required for their project or regulatory compliance.
